Firearms & Ammunition Purchases

Customer Affirms the Following

• • You are not prohibited under federal law from purchasing and/or possessing firearms.  Individuals who are prohibited under federal law include any person who is,
    • • • • Under indictment or information in any court for a crime punishable by imprisonment for a term exceeding one year
          • Convicted of a crime punishable by imprisonment for a term of more than a year
          •  A fugitive from justice
          • An unlawful user of or addicted to any controlled substance
            • • • Updated Language on Form 4473, “The use or possession of marijuana remains unlawful under Federal Law regardless of whether it has been legalized of decriminalized for medicinal or recreational purposed in the state where you reside”
          • Has been adjudicated as a mental defective or has been committed to any mental institution
          • An illegal alien
          • Has been discharged from the military under dishonorable conditions
          • Is subject to court order restraining the person from harassing, stalking, or threatening and intimate partner or child of the intimate partner
          • Has been convicted of a misdemeanor crime of domestic violence
    • You are not prohibited under local or state laws from purchasing and/or possessing a firearm.
    • You will use all products purchased from Western Mountain Sports for lawful purposes.
    • You will not export any items you purchase from Western Mountain Sports.
    • All contact information is up to date and correct.
    • You are at least 18 years of age for long gun and long gun ammunition purchases.
    • You are at least 21 years of age for handgun, lower receivers, and handgun ammunition purchases.

Customer Responsibilities:

• • • You are responsible for ensuring your firearms purchase is in compliance with any local or state laws.
    • You are responsible for ensuring that any ammunition and magazine purchase is in compliance with any local or state laws.
    • You will ensure your local firearms dealer will accept the transfer of your firearms order.
    • You are responsible for completing all required paperwork for firearms transfers when you pickup your firearm(s) from your local dealer.
    • You understand and accept that any transfer fees your local dealer may charge are your responsibility and are not factored into the cost of our firearms.
    • You accept that there is a fee for any firearm transferred to Western Mountain Sports (please see Firearms Transfers).
    • Customers are responsible for all activities performed under your user account.

Firearms Purchases for non-Residents:

• • • A non-resident purchasing a firearm in Maine is subject to the same requirements as a Maine resident, in addition to the laws and regulations governing his or her state of residence.  
    • The Firearms Owners Protection Act of 1986 allows for over-the-counter purchase of firearms (long guns only) provided the buyer complies with the laws of both the state in which the firearm is purchased and the state in which residency is claimed.  
    • Non-residents may not purchase handguns in an over-the-counter transaction in the state of Maine. An authorized transfer dealer in the purchaser’s state of residence is required to complete a handgun transaction in Maine by a non-resident.  
    • Please familiarize yourself with the laws and regulations governing your state of residence as some states/municipalities do require special permits to possess a firearm.

Transfer Fee Conditions:

General:  The $15 dollar Transfer Fee applies to transfers that Western Mountain Sports has agreed to accept for a customer and includes a total number of firearms that the ATF Form 4473 provides for.  Currently, this form accommodates for up to 5 (five) firearms. This offer is valid on transfer that contain up to 5 (five) long guns, 1 (one) handgun, or a combination thereof.  Any transfer where the total number of of firearms exceeds these conditions may be subject to an additional fee and restrictions.  Additionally, any firearm(s) that are transferred to Western Mountain Sports without prior agreement are subject to an additional fee. 

Handguns:  Sales of multiple handguns within a 5 day period are required to be reported to the the ATF, therefore it is the Policy of Western Mountain Sports that no customer shall be transferred more than 1 (one) handgun in a period of 5 business days.  Any order that includes multiple handguns will be completed following this policy, all additional transfers required in order to complete the customers transaction will incur a fee of $2. 

Transfer without Agreement:  In the event that firearms are transferred to Western Mountain Sports, without prior agreement, there shall be an additional fee of $5 per firearm.

We Reserve the Right:  Western Mountain Sports reserves the right to refuse any transfer of firearms at our sole discretion.  

Shipping Restrictions:

• • • All firearms must be shipped to individuals or businesses with a valid Federal Firearms License.
    • We cannot ship items to P.O. Boxes.  Physical addresses are required.
    •  Western Mountain Sports will not ship complete firearms to the following locations:
      • • • Alaska, California, Connecticut, Illinois, Hawaii, Maryland, Massachusetts, New Jersey, New York, Washington D.C.
          • Orders to these states of complete firearms will be cancelled

Pricing & Fees

Products Prices

Western Mountain Sports works to provide customers with the best prices possible while remaining competitive.  However, various manufacturers have implemented Minimum Advertised Price (MAP) policies. These pricing policy set a minimum price that a retailer can advertise a product.

License & Site Access

Western Mountain Sports grants you (the user) a limited license to access and make personal use of this website. This license does not include the right to download any material (other than routine page caching), modify any material, or any portion thereof, without the express written consent of Western Mountain Sports. This license excludes the download or collection of logos, product descriptions, pricing, text, graphics, audio and video clips, and/or copying account information. This website or any portion of this website may not be reproduced, duplicated, copied, sold, visited, or otherwise exploited for any commercial purpose without express written permission of Western Mountain Sports. You are prohibited from using meta tags or any other hidden text utilizing Western Mountain Sports’ name or trademarks without the express written consent of Western Mountain Sports. Any unauthorized use of this websites voids the limited license granted by Western Mountain Sports.
